Connecticut Negligence Law | Conn. Gen. Stat. § 52-572h
Connecticut follows the modified comparative negligence principle. As outlined in Connecticut General Statute § 52-572h, contributory negligence doesn’t bar anyone from recovering damages. This means that a plaintiff (i.e., the party seeking compensation after an accident) can still file a suit if they are partially at fault for an accident. However, a plaintiff cannot be 51% or more at fault for the incident, and their settlement will be reduced by their portion of fault.
For example, a motorcyclist who was rear-ended by a distracted driver sought compensation for medical expenses and lost wages. Although the investigation revealed that the motorcyclist was not wearing a reflective vest and had made an unexpected lane change, he was found to be 40% responsible for the accident. Under Connecticut's comparative negligence statute, he was still eligible to recover damages. His total damages were calculated at $100,000, but because he was deemed 40% at fault, his settlement was reduced proportionally to $60,000.
